Mahoneys dedicated Body Corporate team was featured in LookUpStrata’s magazine – where on pages 14 & 15 we discuss a body corporate’s right in relation to Land Access and Activity Notices (or LAANs).
Since we first raised this issue last year, we continue to see an increase in telecommunication providers seeking to access a body corporate scheme via a LAAN to:
- inspect a scheme to assess the viability of installing certain telecommunications facilities; and / or
- carry out works to install certain types of telecommunication facilities…
…commonly known as Telco Rights.
In a growing trend, telecommunication providers are using LAANs to access body corporate land to undertake work that may go beyond Telco Rights.
It is important for body corporate committees, and body corporate managers, to understand that in certain circumstances the body corporate has a legal right to oppose the Telco Rights.
In this article we discuss Telco Rights and the body corporate rights to object to a LAAN in more detail – here.
