For a second week in a row, we have a second round of new body corporate legislation.
This time it’s temporary relief for bodies corporate to allow for greater flexibility in administering the scheme as a result of COVID-19.
The main changes relate to:
- allowing modified general meetings in contemplation of the social distancing requirements – which applies to meetings held between 19 March 2020 and 31 December 2020 and is an issue we wrote about here https://www.mahoneys.com.au/the-first-virtual-general-meeting-has-been-challenged/;
- giving the committee the power to restrict access to common property (which was previously a restricted issue meaning a general meeting was required to close a pool). This power of the committee will apply between 2 October 2020 and 31 December 2020 and is an issue we wrote about here https://www.mahoneys.com.au/closing-facilities-in-a-body-corporate/; and
- more flexible arrangements for records requests and inspections to apply between 2 October 2020 and 31 December 2020.
There are also some other minor changes related to the Commissioner’s Office being able to waive certain fees in some circumstances.
